Common Causes of Rollover Accidents
Rollover accidents have many causes beyond simple careless driving. Road conditions, speeding and the type of vehicle involved can all be contributing factors. In fact, it can sometimes be difficult to determine who or what is primarily responsible. As your legal representatives, we work to determine liability and secure the compensation you deserve by carefully investigating all factors relating to your accident.
Side-impact collisions: Especially when a side-impact collision occurs at high speed, the laws of physics often dictate that the result will be a rollover accident. A car struck on its side may become sufficiently unbalanced that it will roll over. Or, a side-impact collision can cause the struck vehicle to leave the roadway, causing a rollover to occur due to an uneven road surface or loose gravel at the shoulder or on the median.
Vehicle types: Rollovers can often be attributed to specific types of vehicles. Although any car, truck, or van can roll over, certain design elements make a vehicle more susceptible to a rollover accident. Vehicles with a high center of gravity, such as SUVs or passenger vans, are much more likely to roll when struck. A passenger vehicle struck by an 18-wheeler is also likely to roll, given the great disparity in size between the two vehicles. Some vehicles may not be especially susceptible to rolling but still be vulnerable to roof crush, which tend to result in more serious injuries for passengers in a rollover accident.
Speed: Speed is frequently a factor in rollover accidents. A majority of fatal rollover accidents take place in areas with speed limits in excess of 55 miles per hour.
Driver behavior: Careless driving causes most rollovers in one way or another. Carelessly weaving in and out of lanes on a high-speed road can lead to a rollover collision. Speed in excess of posted limit can lead to a rollover accident. Drivers who are distracted by performing other tasks such as changing radio stations, talking on cell phones, or texting may cause side-swipe accidents, which frequently cause the impacted vehicle to roll. Tire blowouts caused by a driver's or mechanic's failure to adequately repair or maintain a tire is another common cause of rollover accidents.
Hit-and-Run Accidents and Accidents With Uninsured Motorists
Rollover accidents are sometimes mistakenly called "one-car accidents." When law enforcement arrives on the accident scene, there may be only one disabled vehicle in sight. This does not mean, however, that the driver of the rolled vehicle is automatically responsible for the accident - the responsible driver may have failed to stop. In such a case, you need to hire a lawyer who is familiar with the special challenges presented by hit-and-run car accidents or cases involving uninsured drivers.
